The LCSG of the IUAI comprises leading legal and claims practitioners from the aerospace insurance and reinsurance industry. The group meets on a regular basis to discuss relevant legal and claims related issues currently facing the aerospace sector. Through the vast experience of its members, representing various geographical regions and specialities, the group identifies developing claims trends and legal issues, and also provides practical feedback from their everyday involvement in the handling of aerospace claims.

The group includes a Legal Advisor who helps to ensure that the IUAI operates within the appropriate legal and governance frameworks and who also produces a quarterly legal update to all members highlighting recent legal developments of relevance to aerospace insurers and reinsurers.

Giles Kavannagh Presentation “Transmissible Diseases – The Potential Impact on Airlines & Insurers

Presentation by the Union's Legal Advisor, Giles Kavanagh, and which was part of the LCSG's Plenary Session from the Union's AGM in Bengaluru, 2015, and which is still pertinent to the issues being faced by insurers and their clients in early 2020.

2019 Plenary Session

Brendan Lumb opened the 2019 Legal & Claims Session by providing the traditional Major Loss Update, which included a look at airline fatal accident statistics and an overview of major airline losses from the past decade.

This was followed by Giles Kavanagh, who commented on some recent decisions in Superior Courts across a number of jurisdictions around the world and their possible impact on the protections traditionally afforded to airlines (and their insurers) under current Conventions.

Sharon Holahan then provided an in-depth study of helicopter losses, and Kerry Porter then made the final presentation prior to lunch, looking at policy language, specifically the possible gaps between underwriters’ intentions on coverage and Courts’ interpretations as to the meanings.

Sébastien Saillard opened the Tuesday afternoon sessions by looking at some of the peculiarities of the French litigation system. This was followed by the LCSG Chairman, Natsuyuki Furumai, who outlined to Delegates some changes in the Japanese legal regime dealing with the investigation of, and compensation for, damage arising from objects falling from aircraft.

The final presentation from the LCSG was by Guest speaker David Hitchen of McLarens Aviation. In a complementary presentation to Simon Abbott’s item during the MPASG session, David made a comprehensive review of grounding issues from a wider industry perspective, including looking at some of the reasons why grounding is becoming more prevalent, some of the root causes behind the increase in both occurrence and non-occurrence groundings and possible short and long-term impacts of these events.

HFW Aero Quarterly Magazine

The Aerospace Team at Holman Fenwick & Willan (HFW), led by the Union’s Legal Adviser Giles Kavanagh, has released the first of a new Quarterly Magazine – HFW Aero.

The magazine has the HFW Team’s take on some of the legal, regulatory and commercial issues that they think should be on your radar as well as having comment and insight from some of the industry’s leading figures,

The first issue includes

- Etihad General Counsel Henning zur Hausen talking about the need for a united industry and regulatory response to Covid-19

- A “deep dive” into the fascinating world of sustainable aviation fuel, which could be key in helping the industry combat climate change.

Both of these topics are ones on which the Union is currently working on behalf of the Membership.
